The
tender should be submitted in two packet systems, Packet
–I should consist of details of only technical and financial
capabilities which should be furnished in the proforma given
in the tender document together with the particulars in support
of the capabilities in regard to eligibility criteria given
under para 3 below. No conditions having any financial implications
should be included in packet–I. Packet -II shall consist of
financial bid and will contain all commercial offers. On the
date of opening mentioned above, only packet –I will be opened.

Similar Work: |
| |
The
contractor should possess the experience of having successfully
completed/ substantially completed a similar work in the preceding
15 years (i.e. current financial year and 15 previous financial
years) from the date of opening of the tender as defined below:

Similar
work shall mean one composite work of fabrication, assembly
and launching of steel triangulated open web through girder
super-structure of a bridge with span of 90 m or more for
a rail bridge or rail cum road bridge or road bridge. The
work of launching should include at least two adjacent spans
of atleast 90 m over a perennial river/creek/deep viaduct/deep
khud.

| |
Two
separate works of fabrication and assembly & launching
of steel triangulated open web through girder super-structure
of a bridge with span 90m or more for a rail bridge or rail
cum road bridge or road bridge. Out of the two works, one
work can be of fabrication alone i.e. without launching and
one work can be for assembly and launching alone. The work
of launching should include at least two adjacent spans of
at least 90 m over a perennial river/creek/deep viaduct/deep
khud.

Notes :- |
| a) |
Substantial
completion for the on going contracts means those works for
which at least 70% billing is completed as on the date of
submission of bids (i.e. gross value of work done up to the
last date of submission of bid is 70% or more of the original
contract value) and continuing satisfactorily. Besides
this contractor should have done fabrication, assembly and
launching of at least 2 spans of 90 mtr or more against the
contract. The launching would mean launch of a girder from
one pier to other irrespective of whether lowering, placement
on bearings etc. have been done or not.

| b) |
For
above completed/ substantially completed works, a certificate
from the employer shall be submitted along with the bid incorporating
clearly the name of the work, contract value, billing amount
during the preceding 15 years (i.e. current financial year
and 15 previous financial years), date of commencement of
works, satisfactory performance of the contractor and any
other relevant information.

| 3.2 |
Financial |
| 3.2.1 |
As
a proof of sufficient financial capacity, the tenderer should
have received total payments against execution of all completed/
on going works amounting to at least Rs.150 crore in the best
3 years out of preceding seven years ending on 31.03.2007.
The payment received/ turnover should be duly certified by
chartered accountant and audited balance sheet should be submitted.

| 3.2.2 |
The
tenderer should submit revenue/ Banker’s solvency certificate
for at least 40% of the advertised value of work.
|

a)
Indexing/Escalation of total payments as mentioned in para
3.2.1 shall be done as below:

The
base year shall be 2006-07. The following enhancement factors
will be used for the costs of works executed and the financial
figures to a common base value for works completed in India.

b)
In case the financial figures are in foreign currency, the
above-enhanced factors will not be applied instead, the foreign
currency will be converted into equivalent Indian rupees (INR)
at the BC selling rate published in the news paper “The Economic
Times” as on the date of submission.

c)
Tenderer should indicate total payment received for the works
executed by them in the schedule without accounting for the
above mentioned factors.
|
| 3.3 |
Fabrication
& Design Capability: |
| 3.3.1 |
Design
of the girders shall be supplied by the Railway. The tenderer
should have in house capacity for detailing to enable them
to prepare working drawings for fabrication & assembly.
The tenderer should submit documentary proof in support of
having in-house capacity or through their associates in this
regard. Tenderer or their associates should have handled such
type of job for open web triangulated girders during proceeding
five yearls i.e. current year and five previous financial
years satisfactorily.

| 3.3.2 |
The
tenderer should have well established workshop to carry out
welded/riveted fabrication and assembly of triangulated girders.
The tenderer should have done fabrication of structural steel
to the tune of 20,000 MT in the last five years ending on
31.03.2007, out of which at least 8,000 MT should be pertaining
to fabrication of girders.

However,
the capacity will have to be augmented to the level of fabrication
of 2000 MT per month to suit the over all target of completion
of this bridge. In case, tenderer proposes to set up
a workshop at the work site or at any other location to augment
the fabrication capacity, the tenderer shall establish their
capability to set up and operate such work shop in 6 months
(from the date of award of tender) by way of method statement
and experience of doing so in the past. Schematic layout of
work shop giving flow diagram of operation, fabrication scheme,
details of machinery and plants and key personnel for each
operation be given in the tender.

In
support of the above, the tenderer shall submit the following
documents distinctly mentioning (i) existing capability (ii)
proposed enhancement to have total minimum average turnover
of 2000 MT per month and their time frame:
|

a)
Schematic plan of fabrication of 125m span open web girder. |
| |
b)
Organization with qualified key personnel. |
| |
c)
Methodology and capability of providing shop drawings, fabrication
plan etc. |
| |
d)
Details for deployment of the workshop resources (Plant and
machinery) with land plan required for workshop.
|
| 3.4 |
Joint
Ventures/Consortium:
|
| i) |
Number
of constituent forming the Joint venture/ consortium (JV)
for the execution of work will not be more than three (3).
|
| ii) |
Each
partner should individually satisfy one of the following criteria:
|
| |
a) |
Fabrication
of steel triangulated open web through girder super-structure
of a bridge with span 90m or more as per para 3.1.1 and fabrication
& design capability criteria as per para 3.3
|
| |
b) |
Assembly
& launching of steel triangulated open web through girder
superstructure of a bridge with span 90m or more as per para
3.1.1.
|
| |
c) |
Firm
should have received total payments against the execution
of all completed/ ongoing civil engineering works (sub-grade,
bridges, workshop structures and similar works) of a gross
value of Rs. 470.95 Cr. or more in each of the last three
financial years.
|
| |
But
all the partners/constituents taken together should satisfy
criteria as per para 3.1 & 3.3.
|
| iii) |
The
total payment, as per para 3.2.1 above, of JV/ consortium
partners shall be evaluated by weighted payment of the partners
in ratio of their respective share. Same methodology will
be adopted for the evaluation of solvency.
|
| iv) |
One
of the constituents of the JV/ consortium shall be nominated
as “In-charge” during the bidding period and, in the event
of a successful bid, during execution, he will be called the
“lead partner”.
|
| v) |
The
lead partner must be an Indian constituent.
|
| vi) |
The
lead partner shall have a share of minimum 40% in the joint
venture/consortium and the other partners should have at least
20% share each. In case of joint venture/consortium between
Indian and foreign partner(s), Indian lead partner should
be fully responsible for failure to execute the work successfully
apart from liabilities of other partners.
|
| vii) |
While
submitting the offer, the joint venture/ consortium proposition
should clearly indicate as to who, out of the constituents,
would be lead partner. The lead partner would also be authorized
to incur liabilities and to receive instructions and payments
for and on behalf of the JV/ consortium.
|
| viii) |
The
joint venture/ consortium agreement will clearly indicate
the activity which will be performed by the individual constituent
firm of the JV/ consortium in respect to the following:-
|
| |
- Fabrication
and trial assembly.
|
| |
- Assembling
and launching.
|
| ix) |
In
case of foreign firm(s) being one of the constituent(s) of
JV/ consortium, the foreign firm(s) should also submit its
part of the commitment in Foreign Notarized Paper.
|
| x) |
The
name of the JV/ consortium should not be synonymous with the
name of any one of its constituents.
|
| xi) |
Tender
paper should be submitted in the name of the JV/ consortium.
|
| xii) |
The
earnest money should be submitted in the name of the JV/ consortium
only.
|
| xiii) |
All
constituent firms of the joint venture/ consortium shall be
jointly and severally responsible for the successful execution
of the contract in accordance with contract terms. All the
legal fallouts of the failure to execute the work successfully
will be applicable to the JV/ consortium as well as individually
to the constituent firms of the JV/ consortium. Specific clause
to this effect should be included in the Joint Venture/ consortium
agreement. The agreement shall be valid for the entire period
of completion of the work.

| xiv) |
JV/
Consortium formed after the submission of tender shall not
be accepted.
|
| xv) |
(a) A copy of the joint venture/
consortium agreement (which should also take in to account
the above conditions) entered into by the constituents on
non judicial stamp paper duly attested by Notary Public with
seal and revenue stamp affixed shall be submitted along with
the tender.
(b)
The JV agreement should be got duly registered as per law
before issue of the acceptance letter.

| xvi) |
The
resolution(s) of all disputes and issues as well as arbitration
shall be in Indian Territory only.
|
| 4.0 |
Detail scope of work is available in the tender document.
|
|
5. |
(a)
|
Advance to the contractor is applicable as per provisions
made in tender document.
|
| |
(b)
|
Purchase preference clause is not applicable.
|
| |
(c)
|
Price variation clause is applicable.
|
| 6. |
Performance Guarantee (P.G.): Please note that in addition
to Security Deposit, the successful Contractor will have to
submit a performance Guarantee @ 5% of Contractual value in
form of a Bank Guarantee Bond in token of commitment to complete
the work successfully. The Performance Guarantee will have
to be deposited after the Letter of acceptance has been issued
but before signing of the Agreement and should be valid up
to expiry of the maintenance period. Details in this regard
are available in the Tender document.

(a) |
Performance
guarantee shall be released after satisfactory completion
of the work and maintenance period is over. The procedure
for releasing should be same as for security deposit.
|
| |
(b) |
Whenever
the contracts are rescinded the security deposit should be
forfeited and the performance guarantee shall be encashed
and the balance work should be got done separately.
|
| |
(c) |
The
balance work shall be got done independently without risk
& cost of the original contractor.
|
| |
(d) |
The
original contractor shall be debarred from participating in
the tender for executing the balance work. If the failed contractor
is a JV or a partnership firm then every member/partner of
such a firm would be debarred from participating in the tender
for the balance work either in his/her individual capacity
or as a partner of any other JV/Partnership firm.
|
| 7.0 |
Tender
forms are available from the office of CAO/Con/EC Rly. Mahendrughat,
Patna on production of demand draft from any nationalized/Scheduled
bank in favour of FA & CAO/Con/ECR, Mahendrughat, Patna
or money receipt issued by the Divisional Cashier, East Central
Railway, Danapur/Sonepur or for the cost of tender document
mentioned above between 10.00 Hrs. to 16.00 Hrs on any working
day. In case any tenderer wishes to obtain the tender document
by post, Rs. 500 (Five hundred) extra should be sent by demand
draft in favour of FA & CAO/C/EC Rly, Mahendrughat, Patna.

Tenders
can be dropped in prescribed tender boxes placed in offices
of the CAO/Con/E.C Rly., Mahendrughat, Patna, and CAO/Con/
Northern Railway, Kashmiri gate, Delhi up to 12.00 hrs. of
the date of opening and tender will be opened at 12.30
Hrs on the same day simultaneously at Patna & Delhi
in presence of tenderers, present at the time of opening
of the tender. If the office is closed on the stipulated date
and time due to some unforeseen holiday, tender will be received
upto and opened on the next working day at the same place
& time.

Tender
can also be sent to Chief Admn. Officer, E.C. Railway, Mahendrughat,
Patna-4 by registered post/speed post/courier service to reach
before 12.00 hrs. of the date of opening. However, Railway
will not be responsible for non receipt or delayed receipt
of such tenders.

| 10.0 |
The
tender must be submitted with proper amount of Earnest Money
in favour of FA & CAO/Con/ECR, Mahendrughat, Patna. Tender
without proper Earnest Money will be summarily rejected. The
tender form is not transferable.
|
| 11.0 |
MODE
OF EARNEST MONEY:
|
| |
Out
of the total Earnest Money as stipulated in these documents,
Rs.1,00,00,000/-(Rupees One Crore) may be paid by the tenderer
in any one of the following forms and balance
Rs.3,95,94,000/- (Rupees Three Crore ninety five Lakh ninety
four thousand only) may be in the form of bank guarantee having
validity of one year:-

(a) |
Deposit
in cash with Divisional Cashier/East Central Railway, Sonepur
or Danapur and to attach the money receipt obtained thereof
with the tender documents.
|
| |
(b) |
Deposit
Receipt or pay orders or demand draft from the state bank
of India or from any of the Nationalised banks drawn in favour
of Financial Adviser and Chief Accounts Officer/Con/ East
central Railway, Patna and endorsed “Account Payee” and valid
upto the validity of tender offer. No conformity advice from
the Reserve Bank of India will be necessary.

(c) |
Deposit
receipts executed by the schedule Banks (other than the State
Bank of India and the Nationalized Bank) approved by the Reserve
Bank of India for this purpose. The Railways will not, however,
accept deposit receipt without getting in writing the concurrence
of the Reserve Bank of India.
