Sub: Quotation for cutting and removal of grass, jungles, bushes, shrubs and trees from GRSE Ltd (Main Yard), Kolkata.
 

You are hereby requested to submit sealed quotation indicating your lowest rate for the items as per attached schedule to execute the work detailed hereunder in accordance with the following terms at GRSE, Main Yard at 43/46, Garden Reach Road, Kolkata - 700024 :-
 
1.
Scope of work:
 
A.
Cutting and removal of the total grass, jungles, bushes and shrubs from all open areasand Docks, Ganges - once in two months (one cut).
 
B.
(i)
Unwanted trees / shrubs / banners etc., removal on the various buildings – once in two months.
 
(ii)
Unwanted trees / shrubs / banners etc., removal on and either side of boundary wall /fencing (four sides) - once in a two months.
 
(iii)
Unwanted trees / its branches trimming & removal from Main Yard on demand per occasion / as & when required.
 
C.
Adequate resource mobilization must be made by the contractor for the above jobs.
 
2.
The contractor shall arrange for cutting & removal of the above, hereinafter referred to as “the grass and jungles” from the GRSE, Main Unit, on as is where is basis, at his own expenses, arrangements, workmen, transportation, materials, equipments, cutting tools, safety and personal protective equipments, safety & risk. Cutting & removal of grass and jungles from the said area shall be made by the contractor regularly to meet the above target stated in scope of work i.e. @ one complete cut at whole GRSE Main Yard / premises in two months time. Cutting of grass and jungles etc., shall be carried out strictly as per instructions of Yard Maintenance Office or any other persons authorized by DGM (ES).

Party should quote their rate on “per cut rate basis”; total there will be six cuts per year. Order will be issued for one year; however the same may be considered for renewal further if the performance of the vendor is found satisfactory.
 
4.
Please mention PF & ESI No obtained in the name of the vendor; offers of the vendors having these only will be considered for acceptance.
 
The quotation shall be kept valid for 120 days (one twenty days) for acceptance from the date of tender opening. No Telegraphic quotation will be accepted. Price quoted shall be firm & final without any escalation whatsoever till the actual completion of work/contract period and inclusive of all taxes, levies and duties. All rates shall be quoted on the tender schedule both in figures as well as in words. In case of any discrepancy found between the rate/amounts quoted in figures and words, the rate/amounts quoted in words will be considered for acceptance. GRSE Ltd, reserves the right to accept or reject any or all the tenders without assigning any reason thereof.
 
5.
Work has to be carried out in a site along with other agencies without affecting normal activities of GRSE.
 
6.
Inspection of site, if felt necessary, may be carried out along with representative of YMS Dept, on any working day against prior appointment.
 
7.
The contractor will have to arrange for removal of any materials lying on or around the jungle, grass, bush and shrubs to facilitate proper cutting.  The said materials are to be kept properly at the same place after cutting and removal of the cut grass, jungles, bushes and shrubs by the contractor as far as possible.
 
8.
The offer must be submitted in 2 (Two) separate sealed envelopes one containing technical, commercial terms, unpriced bid and payment of earnest money while the other envelope containing price bid only. The sealed envelopes should be clearly marked as per contents. Both the sealed envelopes should be put in another single envelope. The envelope containing technical, commercial, unpriced bid and earnest money will be opened first. The price bids will be opened only after the bidder has complied with all the terms and conditions and if the offer is technically responsive. The price bid of the bidder who has not fulfilled the terms and conditions of the tender and whose offer is not technically responsive may not be opened and considered at all.
 
9.
Contractor shall have to provide adequate number of workmen and supervisors to achieve six cuts per year in accordance with scope of work described in clause no 1 above, with additional manpower as required for cutting extra growth, especially in the monsoon season. Contractor has to provide workers on Sundays and any holidays too and also during any requirement by YMO / DGM (ES) / their representative, in case of emergency and should complete the tasks / jobs as assigned in a stipulated time.  Contractor has to remove the waste grass/cutting material (done by the vendor) within 48 hours after cutting, from GRSE, Main yard.
 
10.
Liquidated Damages: If the contractor fails to complete the work within the stipulated time, the contractor shall be liable to pay GRSE Liquidated Damages for delay and not by way of penalty, a sum of ˝ % per week of delay or part thereof, subject to a maximum of 5 % of the total value of the order.
 
11.
Any stoppage / suspension of the work or delay in cutting / removal shall be treated as a breach of contract and Garden Reach Shipbuilders & Engineers Ltd., reserves the right to deploy such number of labourer to keep the premises of Main Yard, GRSE, Kolkata, clean and all cost / loss for such operation will be deducted from the bills of the contractor.
 
 
12.
The contractor shall have to deposit an Earnest Money Deposit amounting to Rs. 27,000/- (Rupees Twenty Seven Thousand only) along with quotation by way of DD / PO drawn on any Nationalized Bank payable at Kolkata, in favour of  Garden Reach Shipbuilders & Engineers Ltd..  EMD of un successful bidder will be refunded against submission of application and original money receipt issued by GRSE Ltd., Earnest Money Deposit (EMD) of the successful bidder will be converted into Security Deposit (on demand), which will remain in the custody of GRSE Ltd., throughout the period of the contract and will be refunded after satisfactory completion of the contracted work/period.  Earnest Money Deposit / Security Deposit will not earn any interest.  Security Deposit will be forfeited by GRSE Ltd., in case the contractor fails to complete the work to the satisfaction of GRSE Ltd., or in case of violation of any terms and conditions of contract.
 
13.
100% payment will be made on submission of bill in triplicate after each cut (once in two months) attaching therewith job completion certificate issued by Officer Yard Maintenance indicating satisfactory cutting & removal of grass, jungles, bushes, shrubs, trees etc., from Main Yard and thereafter subject to clearance of PF & ESI etc., deposited for the workmen employed by the contractor against this contract etc., from authorities, nominated by GRSE.
 
14.
Labour:
 
The contractor is required to pay all legal dues to the workmen engaged by him, as per the laws in force. The relevant acts which are to be complied with in this connection are contract labour (Regulation & Abolition) Act 1979, P.F. Act, 1952. Bonus act 1965, ESI Act 1948. WB House Rent Allowance Act 1974 & Gratuity Act 1972.
 
The minimum wages paid to the contract labour/workmen shall be in conformity with the Govt.’s direction in this regard.
 
In the event of failure of the contract or to pay to the contract labour/workmen his legal dues, GRSE will reserves the right to deduct such due, from the final bill of the contractor and arrange reimbursement to the concerned labour/workmen.
 
15.
No claim for idle charge due to non-supply of any services or work fronts by GRSE or extra payment like over time etc for any other reasons will be entertained.
 
16.
No claim will be entertained due to sudden fluctuations of rates of labour and materials, freights, taxes and duties etc. at any stage.
 
17.
Tenderers are advised to inspect and examine the site and its surroundings means of access to site and nature of work before submitting the tender. No extra charges/claims subsequent of any misunderstanding or otherwise shall be allowed.
  
18.
Safety:
 
a.
The contractor shall be entirely responsible for the safety of his men during working inside the premises of GRSE Ltd., 43/46, Garden Reach Road, Kolkata 700 024.  The contractor must strictly observe all safety regulations and rules issued by the company time to time and enforce observance of such rules and regulations on the part of his employees.
 
b.
The contractor shall be liable to pay or indemnify GRSE Ltd., and to discharge all such amount that will have to be paid against claims or death of any employee of the contractor in course of working inside the premises of GRSE Ltd., according to the provisions of workmen’s compensation act, or any other rules inforce.
 
c.
The contractor shall indemnify and keep the employer indemnified against all damages and loss whatsoever that may be caused to the property or to the persons of any of its servants or agents as a result of lapses, omissions and commission of the contractor or his agent or his employees.
 
d.
The contractor shall also indemnify and keep the employer indemnified against any loss or damage which it might suffer or sustain on account of the contractor’s failure to observe provisions of the said contract labour act and the rules made there under. Safety measures such as using safety belts etc are to be adopted while working overhead. Contractor will be responsible for any damage caused by them to GRSE property.
 
e.
One full time responsible and qualified supervisor / representative has to be posted at site during progress of the work.
 
19.
As per the Official Secret Act 1923 of Ministry of Home Affairs, Govt. of India, Police Verification Certificate of character antecedents in respect of all employees of Contractors/Subcontractors operating in GRSE Ltd., is required to be submitted by the concerned contractors/subcontract before processing any gate pass for their employees, failing which gate pass may not be issued. However all arrangements to obtain gate passes for the contractor’s workmen, in advance, to be made by the contractor at his risk.
 
20.
All the contractor’s men including the site in charge will wear a red color cloth “Arm Band” of 6” in width with name of the firm written on block letters on it. This arm band is to be put on the left arm at the time of entry into GRSE till the time they leave the factory premises.
 
21.
During the pendency of the contract, the contractor will not employ any Officer of GRSE without GRSE’s written consent, GRSE reserves the right to terminate the contract in case of breach of this stipulation.
 
22.
Termination: GRSE reserves the right to cancel this contract and get the work done through any other agency at the risk, responsibility and cost of the contractor in case of poor performance, failure to maintain the time schedule / for said job.
 
23.
Dispute: In the event of any dispute arising out of or in relation to this contract shall be referred to the sole arbitration of the Chairman & Managing Director of GRSE Ltd., or his nominee and the decision of Chairman & Managing Director of GRSE Ltd, or his nominee, as the case may be, shall be final and binding on both the parties and provisions of the Arbitration Act, 1940, shall not apply to such arbitration proceedings. The enforcement of terms and conditions of the contract as well as services and / or the cause of action shall be deemed to have taken place within the jurisdiction of Alipore Court, 24 Parg. (South) West Bengal, notwithstanding the residence or place of business of the contractor.
 
24.
The bidder who is not enlisted with GRSE yet, should furnish the details of similar work executed in last one year, like Purchase Order No., date, value, completion of certificate, contact details like name, address, telephone no. of the person under whose direct jurisdiction the work was executed of similar work executed in last one year, audited annual accounts statement of last three years for evaluation of financial stability, details of infrastructures including human resources available etc.
 
25.
Tender should be deposited in the tender box kept in the office of the DGM (ES), GRSE Ltd., 43/46 Garden Reach Road, Kolkata-700 024 by 1400 Hrs on 20.02.2008.   Contractor may be present to witness the tender opening on the said date & time. In case 20th February’08 declared a holiday, the tender opening will take place the very next day at the same time at the same venue.
 
26.
GRSE do not bind them to accept the lowest or any tender or to assign any reason(s) thereof. In case of requirement, the said work may be splitted into 2 or 3 Contractors with lowest arrived tendered rates.
 
27.
The contractor wherever required, should organize to forward the relevant Bank Guarantee of schedule Bank, preferably Nationalized Banks., in Banker’s sealed envelop directly to General Manager (Finance), Corporate Finance, super scribing the words ‘BANK GUARANTEE’
 
28.
The contractor or his authorized representative shall report to the Yard Maintenance Officer / authorized person of the company at 43/46, Garden Reach Road, Kolkata -700024, regularly on all working days of GRSE (if required, on holidays too) at 8:30 AM with sufficient number of work men and supervisor in order to meet the schedule for cutting & removal of grass / jungle as per said scope of work. Also man power deputed by the contractor should never be nil through out the tenure of the contract on every working day of GRSE. The contractor may be required to remove materials lying on or around the site to facilitate cutting of grass and jungles.
  
29.
The contractor shall keep the license obtained by him in accordance with the provisions of on Contract labour act, valid and effective and fulfill all provisions of the said Act and Rules framed there under.
 
30.
The contractor and his employees shall observe the regulations regarding office timing of GRSE, discipline and safety/security whilst they are inside the premises of the employer for the purpose of executing the job under this contract.
 
31.
The bidder who is not enlisted with GRSE yet, should furnish the details of similar work executed in last one year, like Purchase Order No., date, value, completion of certificate, contact details like name, address, telephone no. of the person under whose direct jurisdiction the work was executed of similar work executed in last one year, audited annual accounts statement of last three years for evaluation of financial stability, details of infrastructures including human resources available etc.
